Will Usha Vance have her citizenship revoked after Trump’s order on birthright? Fact-Check

Soon After US President Donald Trump signing the Executive Order on Birthright Citizenship, a claim is going viral on social media suggesting that Vice President JD Vance’s wife Usha will have citizenship revoked as her parents were not US citizens at the time of her birth.

Here’s the claim: “JD Vance’s wife, Usha Vance, will have her citizenship revoked if Trump signs his executive order banning birthright citizenship. Her parents were not US citizens at the time of her birth.”

It has been shared here and here on social media.

FACT-CHECK

When Digiteye India team checked further on social media, it found several responses from the US citizens suggesting that the executive order is prospective not retrospective.

“Sec. 2. Policy. (a) It is the policy of the United States that no department or agency of the United States government shall issue documents recognizing United States citizenship, or accept documents issued by State, local, or other governments or authorities purporting to recognize United States citizenship, to persons: (1) when that person’s mother was unlawfully present in the United States and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth, or (2) when that person’s mother’s presence in the United States was lawful but temporary, and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth.

(b) Subsection (a) of this section shall apply only to persons who are born within the United States after 30 days from the date of this order.” Hence, it does not apply to Usha Vance, the wife of Vice President JD Vance and the claim is false.

Claim: Vice President JD Vance’s wife Usha will have her citizenship revoked as her parents were not US citizens at the time of her birth.

Conclusion: Misleading. The executive order on birthright citizenship is prospective not retrospective.
